What attorneys need to know about Florida’s new AI rule for court filings
A Statewide rule addressing AI use
Effective June 15, the Florida Supreme Court has amended Florida Rule of General Practice and Judicial Administration 2.515(d)(2) to address the use of generative AI in court filings.
The rule is intended to provide uniform statewide guidance for attorneys practicing in Florida courts.
The core requirement
Under the amended rule, the signer of a court filing represents that: “the legal authorities identified exist and are accurately cited.”
This obligation applies regardless of whether AI was used in preparing the filing.
Why the rule matters
The Court recognized that generative AI tools can assist with drafting and research, but they can also generate inaccurate content, including fabricated or “hallucinated” legal authorities.
The rule reinforces an attorney’s responsibility to verify the accuracy of all authorities submitted to the court.
